Disqualified director convicted

A former director has been convicted of managing a company while disqualified.

James Kwok, of Benowa, Queensland, appeared before Brisbane Magistrates Court on 4 May 2015 after pleading guilty to managing Pacific Energy International Pty Ltd, between 22 March 2010 and 17 July 2012, despite being disqualified due to a 2006 criminal conviction (refer: 15-065MR).

Mr Kwok was convicted and sentenced to 6 months jail wholly suspended upon entering into a 3 year good behaviour bond.

ASIC Commissioner John Price said, ‘The management of companies carries important obligations. Those who operate companies unlawfully face serious consequences and will be pursued by ASIC.’

The Commonwealth Director of Public Prosecutions prosecuted the matter.

Mr Kwok filed a Notice of appeal in the South Port District Court on 1 June 2015 relating to his conviction. The appeal was heard on 20 August 2015 before Judge Clive Wall. The appeal was dismissed.
