AAT upholds appeal by former director of Reed Constructions Australia

The Administrative Appeals Tribunal (AAT) has upheld an appeal by Mr Derry Bernard Hill against an ASIC decision disqualifying him from managing corporations for one year (refer: 15-099MR). 

The AAT set aside ASIC's decision and ordered that no disqualification order be made. The AAT found that the breaches of duty alleged by ASIC were not established by the evidence. 

Background 

Mr Hill was a director of Reed Constructions Australia Pty Ltd and a number of other entities. He was disqualified from managing corporations for one year commencing on 1 May 2015 after ASIC found he had failed to exercise his powers and discharge his duties as a director with the degree of care and diligence required.
