Before you start your application
Take the time to thoroughly read our Regulatory Guide 186 External Administration: Liquidator registration [formerly PS 186] as it outlines our approach to the registration of liquidators and official liquidators under Part 9.2 of the Corporations Act 2001. It sets out:
  • our approach to the criteria you must meet to become a registered liquidator
  • our approach to what you must do to remain registered as a liquidator, and
  • when we will register you under the categories of ‘official liquidator’ or ‘liquidator of a specified body corporate’

Registering as an 'official liquidator'

When you are ready to begin your application
When you are ready to begin, download a copy of our liquidator's registration kit How to apply for registration as a liquidator. It gives guidance on:

(a)the application process for registration as a liquidator (Section 1); and
(b)what information you must submit with your application to help us make an informed assessment about whether to grant it (Section 2).

This kit also includes relevant regulatory guides, pro formas and other attachments that should be used to prepare your application.

When will you hear about your application?
We aim to form a preliminary view about whether to grant or refuse your application within 6 weeks of receiving all the information and documents required. However, this time will be affected by:
  • whether we are waiting for further information from you about any aspect of the application; and
  • how quickly we receive from third parties any confirmation that we may have requested about information in your application.

To help you ensure that you have included all the relevant material with your application, we suggest you use a copy of our checklist for liquidator registration.

Mail your completed application, together with the prescribed fee of $330 to:

Professional indemnity and fidelity insurance

Refer to Consultation Paper 96 Insurance requirements for registered liquidators for details of how ASIC proposes to administer the new insurance requirements for registered liquidators in section 1284 of the Corporations Act 2001 (as amended on 31 December 2007).

Before we will grant registration you will need to lodge documents to demonstrate that you have adequate and appropriate professional indemnity insurance and fidelity insurance. Until ASIC's policy on the new insurance requirements has been issued, you will need to provide a certificate of currency for the relevant insurance policy/policies and we will contact you if any further information is required.
