03-301 Former Victorian directors charged

Ms Katina Karabatsas of Carnegie, Victoria, and Mr Timothy Charles Graham Wilks of Kew, Victoria, have been charged in the Melbourne Magistrates Court following an investigation by the Australian Securities and Investments Commission (ASIC).
Ms Karabatsas was charged with 17 counts of providing false or inflated invoices. Mr Wilks was charged with two counts of dishonestly using his position as a director of Triple One Group Limited (Triple One) to withdraw money from the company’s bank account.
Ms Karabatsas and Mr Wilks were both former directors of Triple One, an information technology company that went into receivership on 3 October 2001.
The charges against Ms Karabastas relate to allegations that between 25 May 2001 and 5 September 2001, Ms Karabatsas provided 21 false or inflated invoices totalling $990,799 to Australian Guarantee Corporation Limited (AGC). The invoices were for AGC’s purchase of some of Triple One’s debts at a reduced price to help the business obtain immediate cash flow.
The charges against Mr Wilks relate to allegations that between 28 September 2001 and 1 October 2001, Mr Wilks dishonestly used his position to withdraw $58,250 from the company’s bank account.
Ms Karabatsas and Mr Wilks did not enter a plea.
Ms Karabatsas will next appear in the Melbourne Magistrates Court on 20 October 2003. Mr Wilks will next appear in the Melbourne Magistrates Court on 27 January 2004.
Both matters are being prosecuted by the Commonwealth Director of Public Prosecutions.
