04-030 Court upholds Rene Rivkin's conviction and sentence

The NSW Court of Criminal Appeal today upheld the conviction and sentence of Rene Rivkin on one count of insider trading in the shares of Qantas Airways Limited (Qantas) on 24 April 2001.
On 29 May 2003, Mr Rivkin was convicted and was sentenced to nine months imprisonment to be served by way of periodic detention, and was fined $30,000 by Mr Justice Whealey. Mr Rivkin appealed against both his conviction and sentence.
Mr Rivkin will now be required to serve the remainder of his sentence.
The Commonwealth Director of Public Prosecutions conducted the prosecution and made submissions before the Court of Criminal Appeal.
As the trial of Mr Robert (Bart) Doff is due to commence shortly, ASIC will make no further comment on this matter at this time.
