Exempt clearing and settlement facilities operating in Australia
Listed below are the clearing and settlement (CS) facilities that have been exempted by the Minister from the CS facility licensing provisions in accordance with Chapter 7 of the Corporations Act 2001.

We will add to this list when new exemptions are approved. Exemptions are effective from the date of gazettal or at a later date specified by the Minister.

Eligible financial products include over-the-counter interest rate derivatives; over-the-counter inflation rate derivatives; and over-the-counter foreign exchange derivatives that are entered into under an ISDA Master Agreement or under another agreement commonly used to deem an ISDA Master Agreement to be in place between the counterparties. Date of gazettal (and commencement of the exemption) – 8 February 2022. |
