Recruitment specialist convicted of managing companies while disqualified

Keith Henry Sheldrick, a Sydney-based recruitment specialist and management consultant, has been convicted of managing two companies while disqualified.

Mr Sheldrick was sentenced on 6 December 2016 at the Dowling Centre Local Court to a two year good behaviour bond in the amount of $1,000.

An ASIC investigation found Mr Sheldrick continued to act in the management of All Recruiting Services Pty Ltd (All Recruiting Services) and Sheldrick Nominees Pty Ltd (Sheldrick Nominees) despite ASIC disqualifying him on 27 August 2009 from managing companies for a period of five years.

ASIC’s investigation found Mr Sheldrick had breached the Corporations Act by making, or participating in making, decisions that affected the whole, or a substantial part, of the business of the companies All Recruiting Services and Sheldrick Nominees.  

Mr Sheldrick had earlier pleaded guilty on 22 November 2016 to two charges of managing a corporation while disqualified. 

‘ASIC will not tolerate directors that have been banned from managing companies. Directors are banned for good reason and should they continue to manage companies they pose a severe risk to investors, creditors and consumers,' ASIC Commissioner Peter Kell said.

'ASIC has taken criminal action, which should sound a warning to other directors banned from managing companies.'

The matter was prosecuted by the Commonwealth Director of Public Prosecutions.
