CP 392 Digital asset law reform implementation: Proposed standards and guidance

consultation paper – 392

Released 15 October 2026. Comments due 27 November 2026.

This consultation paper seeks feedback on our implementation of the Corporations Amendment (Digital Assets Framework) Act 2026 (DAF Act) (see ASIC's roadmap for digital assets law reform implementation).

Note 1: This consultation refers to regulatory design work that is being developed by Government in parallel to this process. This is intended to enable industry to see a complete picture of the future approach.

This consultation package sets out our proposals to create:

  • regulatory guidance relating to digital asset platforms (DAPs) and tokenised custody platforms (TCPs) – see Attachment 1
  • asset-holding standards – see Attachment 2
  • transactional and settlement standards – see Attachment 3, and
  • financial requirements for operators of DAPs and TCPs – see Attachment 4.

Note 2: The preliminary drafts of legal instruments are attached for illustrative purposes only and the final form of the instruments may change considerably from the preliminary drafts.

To assist in navigating the content of the consultation package, we have included a user guide (see link below).
