Capital Guard AU Pty Ltd (In Liquidation)
Capital Guard AU Pty Ltd (Capital Guard) operated as an Australian financial services licensee that promoted itself as a regulated financial services provider that specialised in acquiring and holding corporate bonds on behalf of clients.
Licence cancellation
On 29 June 2026, ASIC cancelled Capital Guard’s Australian financial services licence after finding that it had engaged in dishonest conduct including the selling of a fake bond and providing false documents to its auditor.

Winding up orders
Following an application by ASIC, on 27 July 2026, the Supreme Court of NSW ordered that Capital Guard be wound up and appointed liquidators.
ASIC took this action to preserve any potential assets for the benefit of creditors and investors.
In making the decision to wind up Capital Guard, the Supreme Court of NSW identified a number of significant concerns, including that Capital Guard purported to sell bonds to retails clients that did not exist, and that $9m of client funds had been transferred to cryptocurrency assets and $4.1m to currency exchange platforms. The Court noted concerns around the lack of involvement in the management of Capital Guard by the sole director, and that it provided false information to its auditor regarding its bond holdings. In particular, the Court found that there was a risk to public interest that warranted the appointment of independent liquidators.

Liquidators
Robert Kirman and Jacinta Nielsen of McGrathNicol were appointed as liquidators of Capital Guard on 27 July 2026 (the Liquidators). The role of the Liquidators is to take control of Capital Guard and wind up its affairs in an orderly way, including take steps to realise any assets on behalf of investors.
